Contest Rules

The Official Rules of the Grayson-Jockey Club Research Foundation’s Horse Photo Contest


By entering the Horse Photo Contest, you (the “entrant”) agree to be bound by these rules and to accept as final all decisions of the judges appointed by the Grayson-Jockey Club Research Foundation (“Grayson”).


PRIZES:
First place winner will receive: A Grayson "Swag Bag" and each finalist (including the first place finalist) will receive:  Autographed photos of our Grayson Ambassadors and a Grayson swag item.


TIMELINE:
Entry submission shall be available on February 1, 2023 and all entries must be received before midnight March 31, 2023 EST in order to be eligible for the contest. No late submissions will be accepted.  Finalists will be chosen on April 3, 2023. Voting for the top entry will open to the public on the Grayson Facebook.com page by April 4, 2023 and all voting shall close at midnight on April 30, 2023. The first place winner will be announced on May 1,2023.


ENTRANTS:
All entries must be original photographic works created solely by the entrant and by entering, entrant represents and warrants that such entries are their own original works and that entrant owns all right, title and license to the photographs. No entries will be accepted or will be valid for this competition if they are joint works comprised of works from multiple photographers or artists or if they are subject to an exclusive license to a third party.

Entrant further represents and warrants that entrant has sufficient legal right and permission from any recognizable, famous or celebrity models and all other persons appearing in the photograph to be able to grant to Grayson the rights granted in the preceding paragraph.

You may enter as often as you wish. There is no limit on the number of photos you may enter.

The contest is open to entrants from the United States of America and Canada. Contest is closed to Grayson, its affiliates, and their respective board members, employees and agents.

Entrants must be 18 years or older.


License:
By entering the contest, entrants grant Grayson, and those authorized by Grayson, a royalty-free, worldwide, perpetual, non-exclusive license to display, distribute, reproduce and create derivative works of the photographic entries, in whole or in part, in any media now existing or subsequently developed, for any educational, promotional, publicity, exhibition, archival, scholarly and all other standard Grayson purposes. Grayson will not be required to pay any additional consideration or seek any additional approval in connection with such uses.
Use of Photoshop, textures and excessive manipulation: Basic post processing such as basic cropping, contrast, curves, sharpening and minor retouching are all acceptable. Any photographs modified beyond such minor changes are subject to rejection at the discretion of Grayson.

Judging:
Grayson staff will select the finalist entries and the finalists will be posted on the Grayson Facebook.com page. Voting for the winning entries will be open to the public on the Grayson Facebook.com page (www.facebook.com/GraysonJockeyClub) with the entries receiving the most votes getting the top prizes (in order of the number of votes received). In the event of a tie, Grayson staff will choose the winning entry.


General:
Entries must be submitted online as JPEG files in accordance with file upload instructions as detailed below:

  • File size under 2MB
  • No borders, identifying text overlay or adjacent credit on contest entries
  • Title will not be considered in judging but will be displayed with winning images
  • Images not adhering to size limitations will be auto resized by image uploading function.

All submissions are final.


Entries considered not complying with the rules and conditions of the contest or in the judging panel's discretion, inappropriate or offensive will be disqualified and removed from website and subsequent judging.


If the contest cannot be run as planned for any reason, including computer viruses, tampering, technical or other problems which damage its operation or integrity, Grayson reserves the right to cancel, delay or modify it.


The contest award prizes, rules and conditions are subject to change without prior notice to all contestants.


Taxes, if any, on prizes are the sole responsibility of the prize winners.


The winners will be notified by email, at the email address provided on each winner’s registration. While every reasonable effort will be made to contact each winner, Grayson is not responsible should prizes go unclaimed.


This contest is void where prohibited by law.


All taxes on a prize won by a U.S. resident, and other expenses related to accepting the prize are the sole responsibility of the winners.  


By participating, you release Grayson, its affiliates, parent, and subsidiary companies, its employees, agents, and officers, and its advertising and promotion agencies, as well as all others associated with the development and execution of this contest, from and against any and all liability with respect to or in any way arising from the contest and the awarding and use of a prize.


IN NO EVENT WILL GRAYSON, ITS LICENSEES AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND/OR RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF THE CONTEST, ACCESS TO, PROVISION OF OR USE OF THE PRIZES.  EVERYTHING PROVIDED BY GRAYSON IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TIMELINESS, ACCURACY OR NONINFRINGEMENT.


Disputes:
As a condition of participating in the contest, you agree that any and all disputes which cannot be resolved between you and Grayson, and causes of action arising out of or in connection with the contest, shall be resolved individually, without resort to any form of class action. Such disputes shall be resolved before a state or federal court located in Lexington, Kentucky which court shall apply the laws of the Commonwealth of Kentucky without regard for principles of conflicts of law.  Your registration for the contest signifies your consent to the exclusive jurisdiction of the state and federal courts located in Lexington, Kentucky. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering the contest), and you further waive all rights to have damages multiplied or increased.  In addition, in connection with any such dispute you waive your right to a jury trial.


Winner Listing:
